Please read these terms carefully before using Trekkr.

1. Introduction & Acceptance

These Terms and Conditions govern your use of the Trekkr mobile application and website (collectively, the "Platform"). By accessing or using Trekkr, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

Trekkr is a marketplace platform that connects users ("Participants") with independent adventure activity organizers ("Organizers"). Trekkr does not itself operate treks, camping events, or any adventure activities.

2. Definitions

• "Platform" refers to the Trekkr mobile application, website, and all related services.
• "Organizer" refers to any individual or entity that lists adventure events on Trekkr.
• "Participant" refers to any user who discovers, books, or attends an event via Trekkr.
• "Event" refers to any trek, camping trip, or adventure activity listed on the Platform.
• "Booking" refers to a confirmed reservation made by a Participant for an Event.

3. Eligibility

You must be at least 18 years of age to create an account or make a booking on Trekkr. If you are booking on behalf of a minor, you accept full parental or guardian responsibility and must ensure all applicable age limits set by the Organizer are met.

4. Organizer Accounts & Listings

Organizers must complete the onboarding process and provide accurate information including name, contact details, operating region, and safety certifications. Trekkr reserves the right to verify, approve, or reject any Organizer account at its sole discretion.

Organizers are solely responsible for:

• The accuracy of all event details including dates, pricing, inclusions, difficulty levels, and age limits.
• Ensuring all guides hold valid certifications relevant to the activity.
• Obtaining all required permits, licenses, and government approvals for events.
• The safety, conduct, and experience of Participants during events.
• Compliance with all applicable laws including the Adventure Tourism Guidelines issued by the Ministry of Tourism, Government of India.

5. Booking & Payment

All bookings made through Trekkr are subject to the Organizer's availability and confirmation. A booking is confirmed only upon successful payment processing and receipt of a confirmation notification.

Payments are processed through our third-party payment gateway partners. Trekkr does not store your card or bank account details. By making a payment, you agree to the payment gateway's terms of service.

All prices displayed are in Indian Rupees (INR) and inclusive of applicable taxes unless stated otherwise. Trekkr may charge a platform service fee on bookings, which will be disclosed at checkout.

6. Cancellation & Refund Policy

6.1 Cancellation by Participant

• More than 14 days before event date: Full refund minus payment gateway charges (typically 2–3%).
• 7–14 days before event date: 50% refund of the booking amount.
• Less than 7 days before event date: No refund. The Organizer may at their discretion offer a credit or rescheduling.
• No-show on event date: No refund under any circumstances.

To cancel a booking, you must do so through the Trekkr app. Cancellation requests sent directly to the Organizer via WhatsApp, Instagram, or other channels will not be considered valid and will not trigger a refund.

6.2 Cancellation by Organizer

If an Organizer cancels an event, all confirmed Participants will receive a full refund of the booking amount within 5–7 working days. Trekkr will make reasonable efforts to notify Participants at the earliest possible time.

Trekkr is not responsible for compensation beyond the booking amount in case of Organizer-initiated cancellations, including any travel, accommodation, or incidental expenses incurred by the Participant.

6.3 Cancellation Due to Force Majeure

In cases of natural disasters, government restrictions, extreme weather, or other events beyond the control of Trekkr or the Organizer, refunds will be handled on a case-by-case basis. Trekkr will communicate the resolution process to affected Participants within 48 hours of the cancellation decision.

6.4 Refund Processing

Approved refunds will be credited to the original payment method within 5–10 working days depending on your bank or payment provider. Trekkr is not responsible for delays caused by the payment gateway or banking institutions.

7. Consent Form & Waiver

Before attending any Event, Participants are required to sign a digital Consent Form provided within the Trekkr app. The Consent Form acknowledges the inherent risks of adventure activities and releases the Organizer from liability for injuries arising from those inherent risks.

Signing the Consent Form is mandatory. Your QR ticket and final booking confirmation will only be issued after the Consent Form is signed. By signing, you confirm that:

• You are medically fit to participate in the activity.
• You have disclosed any medical conditions relevant to the activity to the Organizer.
• You understand and accept the physical risks involved.
• You will follow all safety instructions provided by the Organizer and guides.

8. Participant Responsibilities

• Arrive at the designated pickup point on time. Organizers are not obligated to wait beyond 15 minutes of the stated departure time.
• Carry all required equipment, clothing, and identification as specified by the Organizer.
• Follow all instructions given by guides and Organizers during the event.
• Disclose any medical conditions, allergies, or physical limitations at the time of booking.
• Not participate if you are under the influence of alcohol or any controlled substance.
• Respect the natural environment, local communities, and fellow Participants.

9. Limitation of Liability

Trekkr is a technology platform and marketplace. We are not an adventure operator, travel agent, or insurance provider. To the maximum extent permitted by applicable law:

• Trekkr is not liable for any injury, death, loss, damage, or expense arising from participation in any Event listed on the Platform.
• Trekkr is not liable for any Organizer's failure to conduct an event as described.
• Trekkr's total liability in any dispute shall not exceed the amount paid by the Participant for the specific booking in question.

Nothing in these Terms limits liability for death or personal injury caused by Trekkr's own negligence.

10. Intellectual Property

All content on the Platform including the Trekkr name, logo, design, text, graphics, and software is the intellectual property of Trekkr and is protected under applicable Indian laws. You may not reproduce, distribute, or create derivative works without express written permission.

11. Governing Law & Disputes

These Terms are governed by the laws of India. Any disputes arising from the use of the Platform shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.

Before initiating legal proceedings, Participants and Organizers agree to attempt resolution through Trekkr's dispute resolution process by writing to us at legal@trekkr.in.

12. Amendments

Trekkr reserves the right to update these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. Material changes will be notified via the app or registered email.
